An attempt to extradite four of the men, who are all of Hutu ethnicity, was thrown out by the High Court in 2009 on similar grounds.

Government assurances

The new judgement brought applause from friends and family of the men in the public gallery.

The men have undergone a series of legal hearings during which their defence lawyers argued their lives would be in danger if they were returned.

They face charges including genocide, crimes against humanity, premeditated murder, and participation in acts of devastation, massacres and looting.

The Rwandan government has given assurances they would not face the death penalty.

In the latest ruling, the judge said: "From the evidence I heard and read I have no doubt at all that the overall picture of Rwanda is of an authoritarian repressive state that is not less so than it was and is probably more so than in 2008-9, a state that is stifling opposition in a number of ways.

"There is evidence that the state is suspected of threatening and killing those it considers to be its opponents or they simply disappear at home and abroad.

"There is evidence that suspects can be tortured in secret camps where basic human rights are ignored."

She said she did not the find the extradition requests were compatible with the Human Rights Act 1998.

France-Rwanda: La Survie attaque l'écrivain Charles Onana en justice pour avoir contester dans son livre «la planification du génocide des Tutsis par les Hutus» !

La justice française va nous montrer la vérité sur la planification du génocide rwandais que le TPIR n'a pas pu montrée!

L'écrivain et polémiste Charles Onana a été mis en examen pour contestation de crime contre l'humanité. Il est poursuivi par Survie, la Ligue des droits de l'Homme (LDH) et la Fédération internationale des droits humains (FIDH) pour des propos niant le génocide perpétré contre les Tutsis dans son livre "Rwanda, la vérité sur l'opération Turquoise. Quand les archives parlent", paru en 2019.

Charles Onana avait par le passé déjà été attaqué pour ses déclarations sur la chaine de télévision LCI le 26 octobre 2019. Il avait alors affirmé qu' « entre 1990 et 1994, il n'y a pas eu de génocide contre les Tutsis, ni contre quiconque ». L'Association Communauté Rwandaise de France (CRF) avait porté plainte un mois plus tard, mais cette plainte, non assortie d'une constitution de partie civile, avait été classée sans suite par le parquet de Paris.

Le 28 octobre 2019, deux jours après les propos négationnistes tenus par Onana à la télévision, paraissait aux éditions du Toucan Rwanda, la vérité sur l'opération Turquoise. Quand les archives parlent, le septième ouvrage consacré par cet auteur au génocide des Tutsis et à la région des Grands lacs, depuis Les secrets du génocide rwandais, enquête sur les mystères d'un président, en 2002. Fils spirituel du journaliste Pierre Péan, décédé en juillet 2019, et à qui est dédicacé Rwanda, la vérité sur l'opération Turquoise, Charles Onana fait, dans ses livres, tourner en boucle les mêmes thèmes :

L'attentat du 6 avril 1994 aurait été l'œuvre du Front Patriotique Rwandais (FPR) – il revient d'ailleurs sur ce sujet dans son tout dernier livre Enquêtes sur un attentat. Rwanda, 6 avril 1994, paru en 2021 ; le FPR aurait commis contre les Hutus des crimes comparables à ceux commis contre les Tutsis ; il serait l'unique responsable de la déstabilisation de la région des Grands Lacs ; il n'y aurait pas eu de génocide perpétré contre les Tutsis sous l'égide du gouvernement hutu en place au Rwanda en 1994.

Déposée le 21 octobre 2020 par Survie, la LDH et la FIDH, une plainte avec constitution de partie civile vise cette fois les propos tenus par Onana dans Rwanda, la vérité sur l'opération Turquoise. Une juge d'instruction a été désignée en août 2021 et elle a rendu son avis de fin d'information judiciaire après avoir mis en examen Charles Onana le 3 janvier 2022. Cette mise en examen est habituelle dans les délits de presse où les magistrats instructeurs évitent de rendre un non-lieu et laissent les juges du fond trancher. Les parties en présence peuvent encore, dans un délai de trois mois, demander des actes d'enquête supplémentaires, avant que la juge ne renvoie Charles Onana devant la 17e chambre correctionnelle du tribunal judiciaire de Paris, compétente en matière de presse. Le procès pourrait se tenir dans les dix-huit mois.
